Apple Owes US$5.7 Billion for Infringement of Taction Technology Patents

28 September 2026 By Charter Pacific

Apple Owes US$5.7 Billion for Infringement of Taction Technology Patents as reported by Bloomberg – https://news.bloomberglaw.com/ip-law/apple-owes-5-7-billion-to-litigation-funded-firm-in-patent-case.

On 25 September 2026, a federal jury in San Diego found that Apple infringed three claims across two patents owned by Taction Technology Inc. relating to haptic technology  incorporated into Apple’s Taptic Engine used in iPhones and Apple Watches.

CPC has not yet established that there is any direct correlation or technological overlap between the Taction patents and CPC’s patents at this time. Accordingly, CPC should not interpret the Taction verdict as establishing infringement or validity in relation to any CPC patent.

Nevertheless, the Board considers the decision important because it demonstrates the potentially substantial commercial consequences that can arise where patented technology is found to have been incorporated into very large volumes of consumer devices.

For example in CPC’s Australian Federal Court trial against Apple CPC alleged infringement by:-

  • 49 Apple devices with Touch ID
  • 21 Apple devices with Face ID
  • 48 accessories that work with some or all of those devices.

So the pleaded population was 70 Apple devices, plus 48 accessories — 118 identified products/accessories in total.

The Court grouped those Apple products into five exemplar categories:

  • iPhones/iPads with Touch ID;
  • MacBooks with Touch ID;
  • iPhones/iPads with Face ID;
  • Apple Watches used with Apple devices; and
  • Magic Keyboards used with Apple devices.

CPC’s experts will separately consider whether the reasoning, evidence or damages methodology emerging from the Taction proceedings against Apple’s infringement of three claims across two patents has any relevance to CPC once sufficient public material from the case becomes available.  The US Court documents are expected to be released in December 2026.  In the meantime, CPC will try to identify the cost attributed to each unit that makes up the US$5.7B judgement.
