During the Company’s regular internet searches Charter Pacific found that a Complaint for Declaratory Judgment of Patent Non-Infringement of the Company’s Remote Entry System patents, U.S. Patent Nos. 9,269,208 (“the ’208 Patent”) and 9,665,705 (“the ’705 Patent”) and biometric card security patent, U.S. Patent No. 8,620,039 (“the ‘039 Patent”) had been filed in the United States District Court in the District of Connecticut on 23 May 2022 (US time).
The Complaint against CPC Patent Technologies Pty Ltd and Charter Pacific Corporation Limited was filed by Assa Abloy entities (which includes Assa Abloy AB, Assa Abloy Inc, Assa Abloy Residential Group Inc, August Home Inc, HID Global Corporation and Assa Abloy Global Solutions Inc). In this complaint Assa Abloy reveal that they are business partners of Apple Inc. who are subject to infringement proceedings of the Company’s same Remote Entry System patents, U.S. Patent Nos. 9,269,208 (“the ’208 Patent”) and 9,665,705 (“the ’705 Patent”) in Texas/California USA and Australia. There was no prior contact from the Assa Abloy entities or their legal representatives with Charter Pacific or its US attorneys, K&L Gates in regard to this filing.
Following receipt of the complaint from Assa Abloy, Charter Pacific’s US attorney in this matter, Cantor Colburn, contacted the Assa Abloy entities’ counsel and raised the possibility of a commercial resolution between the Company and the Assa Abloy entities before formerly responding to their complaint, but no resolution has been achieved at this time.
Consequently on 23 August 2022 (US time) Cantor Colburn, on behalf of CPC Patent Technologies Pty Ltd and Charter Pacific Corporation Limited filed its Answer and Counterclaim to Assa Abloy’s complaint dated 23 May 2022 together with a Motion to Dismiss against Assa Abloy AB, Assa Abloy Inc, HID Global Corporation and Assa Abloy Global Solutions Inc for Lack of Subject Matter Jurisdiction in the United States District Court in the District of Connecticut.
