Shareholder Update

15 July 2026 By Charter Pacific

The Company provides the following update information for its shareholders as follows –

  • Abu Dhabi:- The transaction is proceeding, albeit slowly, due to the interruptions caused by the geopolitical conflict in the Middle East.  As the conflict normalises it is expected that the transaction will continue.
  • Tap & Pay Patents:- CPC is seeking to commercialise its Tap & Pay patents and has contacted several potential licensees with a view to entering into mutually beneficial commercial arrangements.
  • Apple Australia:-  On 2 and 3 March 2026 the Federal Court of Australia heard the Appeal and Cross-Appeal from both CPC and Apple and the court has reserved its decision. It is expected that a decision will be made by the Full Court this year. CPC is investigating potential infringement of its Australian biometric patents by other third parties.
  • Apple USA:- The Inter Partes Review (IPR) process instigated by Apple in the USA in now at an end. As a result, CPC has a number of claims for each of its US Patent numbers 8,620,039, 9,269,208 and 9,665,705 that have survived the IPR process and are currently valid and enforceable.  The infringement case against Apple before the District Court of Northern California is currently ‘stayed’ until all of the IPR processes for CPC’s ‘039, ‘208 and ‘075 patents are finalised through the US court system.
  • Assa Abloy and its subsidiaries:- CPC has enjoyed 4 wins in the last 12 months against Assa Abloy and its subsidiaries in respect to CPC’s ‘039, ‘208 and ‘705 patents under the IPR process in various US courts.  There are currently two appeals by Assa Abloy on foot at present for which we will provide updates as they occur.  It should be noted that Assa Abloy subsidiary, HID Global Corporation, provides services to Apple.  The infringement cases for Assa Abloy and its subsidiaries in the District Courts of Connecticut and Western District Texas, Waco Division are currently ‘stayed’ until all of the IPR processes for CPC’s ‘039, ‘208 and ‘075 patent are finalised through the US court system.
  • Apple Germany:- CPC is also in discussions in respect to commencing litigation against Apple in Germany and possibly other European jurisdictions for infringement of CPC’s biometric patents.
