Charter Pacific’s appeal of Justice Burley’s decisions dated 15 May 2025 was heard before the Full Court on 2nd and 3rd March 2026 before Justices Perram, Rofe and Owens. (NSD1288/2025 CPC Patent Technologies Pty Ltd (ACN 615 736 028) v Apple Pty Limited & Anor).
The Court was adjourned and the Justices reserved their decision to be handed down in due course.
Charter Pacific and its legal representatives remain confident that the Full Court will hand down a positive decision in favour of Charter Pacific.
This now clears the pathway for Charter Pacific to progress its infringement claims against companies that infringe its patents registered in Europe.
Details of the Court’s decision will be advised to all shareholders as soon as practicable after it is handed down.
